EXECUTIVE ORDER 2021-1—12 Feb

WHEREAS on the 17th day of March 2020, the Board of Big Horn County Commissioners passed Emergency Proclamation Resolution No 2020-7, A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF BIG HORN COUNTY, MONTANA PROCLAIMING AN EMERGENCY RESULTING FROM THE IMMINENT THREAT OF A DISASTER CAUSING IMMEDIATE PERIL TO LIFE OR PROPERTY THAT TIMELY ACTION CAN AVERT OR MINIMIZE; and

WHEREAS Montana Code Annotated § 10-3-406 provides:

10-3-406.    Authority of principal executive officer. (1) Upon the declaration of an emergency or disaster under 10-3-402 or 10- 3-403 and the issuance of an order as required by 10-3-404, the principal executive officer may:

  • direct and compel the evacuation of all or part of the population from an incident or emergency or disaster area within that political subdivision when necessary for the preservation of life or other disaster mitigation, response, or recovery; and
  • control the ingress and egress to and from an incident or emergency or disaster area and the movement of persons within the area.

(2)   Subject to 7-33-2212(4)(a), the authority to control ingress and egress, as provided in subsection (l)(b), includes the authority to close wildland areas to access during periods of extreme fire danger.

WHEREAS on various dates prior hereto the Big Horn County Commissioners passed various motions that resulted in Presiding Officer (Executive) Orders [hereinafter Orders shall be referred to as Order _______ with the appropriate number].

WHEREAS on the 27th day of July 2020, the Big Horn County Commissioners passed a motion that all previous Orders be revoked. It being understood that if an Order was previously revoked by a subsequent Order that this revocation shall not work a revival of the previously revoked Order and that it is the intent of this Order that all previous Orders be revoked.

WHEREAS on the 12th day of February 2021, the Big Horn County Commissioners passed a motion that, beginning 8:00 a.m. local time, Tuesday, February 16, 2021, that all buildings owned by Big Horn County, unless otherwise normally closed to the public, shall be unlocked during the hours they are normally open, with the exceptions of:

  • Upon the request of the Local Health Officer the Council on Aging facilities commonly known as the Senior Citizen Centers in both Hardin and Lodge Grass shall remain closed to the public, but will continue to serve their patrons by take-out and delivery, until plan to reopen is approved by Council on Ageing Area II and the Big Horn County Public Health Officer.

 

  • The re-opening of the Big Horn County Library shall be in the discretion of the Library Board of Trustees.

It was further moved that each person, unless excluded by Administrative Order of the Twenty­ Second Judicial District Court of the State of Montana, or Local Health Order, whether such person works for Big Horn County or not, entering a building owned by Big Horn County must during their time in the building properly wear a face mask or covering and maintain appropriate social distancing by remaining at least six feet (6) apart from other persons. Signage stating that masks or face coverings shall be required for everyone over the age of five (5) years shall be placed at the door used for the entrance to any building owned by the County with a warning that failure to follow the above rules may result in removal from the building.

NOW THEREFORE IT IS HEREBY

ORDERED,

that all previous Orders are revoked effective 8:00 a.m. local time, Tuesday, February 16, 2021. It being understood that if an Order was previously revoked by a subsequent Order that this revocation shall not work a revival of the previously revoked Order and that it is the intent of this Order that all previous Orders be revoked.

IT IS HEREBY FURTHER ORDERED beginning 8:00 a.m. local time, Tuesday, February 16, 2021, that all buildings owned by Big Horn County, unless otherwise normally closed to the public, shall be unlocked during the hours they are normally open, with the exceptions of:

IT IS HEREBY FURTHER ORDERED that this Order shall become effective at 8:00 a.m. local time, Tuesday, February 16, 2021.

IT IS HEREBY FURTHER ORDERED that this order shall remain in effect until further notice.

IT IS HEREBY FURTHER ORDERED that this Order may be revised, updated, amended, changed, or revoked in whole or in part at any time.
