PRESIDING OFFICER (EXECUTIVE) ORDER 2020-1—20 Mar

WHEREAS on the 17th day of March 2020. the Board of Big Horn County Commissioners’ passed Emergency Proclamation Resolution No 2020-7, A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF BIG HORN COUNTY, MONTANA PROCLAIMING AN EMERGENCY RESULTING FROM THE IMMINENT THREAT OF A DISASTER CAUSING IMMEDIATE PERIL TO LIFE OR PROPERTY THAT TIMELY ACTION CAN AVERT OR MINIMIZE; and

WHEREAS Montana Code Annotated § 10-3-406 provides:

10-3-406. Authority of principal executive officer. (1) Upon the declaration of an emergency or disaster under 10-3-402 or 10-3-403 and the issuance of an order as required by 10-3-404, the principal executive officer may:

(a) direct and compel the evacuation of all or part of the population from an incident or emergency or disaster area within that political subdivision when necessary for the preservation of life or other disaster mitigation, response, or recovery; and

(b) control the ingress and egress to and from an incident or emergency or disaster area and the movement of persons within the area.

(2) Subject to 7-33-2212(4)(a), the authority to control ingress and egress, as provided in subsection (1)(b), includes the authority to close wildland areas to access during periods of extreme fire danger.

WHEREAS on the 20th day of March 2020, the Big Horn County Commissioners passed a motion that all buildings owned by Big Horn County, unless otherwise closed to the public, shall be locked during the hours that they are normally open and that by each public entrance that a notice be posted listing the phone number of each office in that building and asking any person who needs to do business with a particular office in that building shall call the office and a person employed in that office shall meet the person at the doorway and, if needed, accompany the person to their office to facilitate the transaction.

NOW, THEREFORE IT IS HEREBY ORDERED that effective 1:30 p.m. local time on Friday, March 20, 2020, for a period of time up to and through 12:01 a.m. local time March 28, 2020, unless extended by further order that all buildings owned by Big Horn County, unless otherwise closed to the public, shall be locked during the hours that they are normally open.

It is further ordered that by each public entrance that a notice be posted listing the phone number of each office in that building and asking any person who needs to do business with a particular office in that building shall call the office and a person employed in that office shall meet the person at the doorway and, if needed, accompany the person to their office to facilitate the transaction.
